1. Acceptance of Terms
By downloading, installing, accessing, or using the Work Horse macOS application (“Work Horse” or the “App”), you agree to be bound by these Terms and Conditions (“Terms”).
If you do not agree to these Terms, do not use Work Horse.
These Terms constitute an agreement between you and Rufino Group (Pty) Ltd (“we”, “us”, or “our”), a company registered in the Republic of South Africa.
We may update or modify these Terms from time to time. Where material changes are made, we will update the effective date.
2. About Work Horse
Work Horse is a macOS automation utility designed to perform user-configured mouse and keyboard activity.
Depending on the available features and settings selected by the user, Work Horse may:

Generate mouse movement;
-
Generate mouse activity;
-
Generate keyboard activity;
-
Automatically enter user-configured text or characters;
-
Perform automation actions at selected intervals;
-
Assist in keeping a Mac active while an automation session is running; and
-
Interact with compatible applications through simulated user input.
Work Horse performs its core automation functionality locally on the user's Mac.
Work Horse may display third-party advertisements through Google AdMob.
Work Horse does not represent that automated activity is equivalent to physical use of a computer by a person.
3. Eligibility
By using Work Horse, you represent that:

You have the legal capacity to agree to these Terms in your jurisdiction;

You are authorised to install and operate Work Horse on the Mac on which it is used;

Your use of Work Horse complies with applicable laws and regulations; and
-
Your use complies with contractual, workplace, organisational, educational, security, and third-party requirements applicable to you.
You may not install or use Work Horse on a device that you do not own or have permission to control.
4. Licence to Use
Subject to these Terms, Rufino Group (Pty) Ltd grants you a limited, non-exclusive, non-transferable, revocable licence to install and use Work Horse on a compatible Mac that you own or are authorised to control.
Except where applicable law expressly permits otherwise, you may not:

Copy, reproduce, distribute, sell, lease, sublicense, or commercially redistribute Work Horse;

Modify or create unauthorised derivative works of the App;
-
Reverse engineer, decompile, or attempt to extract the source code of the App;
-
Circumvent technical restrictions or security features;
-
Use Work Horse to compromise the security of a device, application, network, or service;
-
Use Work Horse to gain unauthorised access to an account, device, system, or information;
-
Use Work Horse to distribute malware or harmful code;
-
Use Work Horse for unlawful, fraudulent, abusive, deceptive, or malicious purposes; or
-
Use Work Horse in a manner that may damage, disable, overload, or impair the App or another service.
5. User Responsibility and Acceptable Use
Work Horse is an automation utility.
You are responsible for determining when, where, and how you use its automation functionality.
You are responsible for ensuring that your use complies with:

Applicable laws and regulations;
-
Employment agreements;
-
Workplace policies;
-
School or university policies;
-
Information-security policies;
-
Acceptable-use policies;
-
Device-management policies;
-
Third-party application terms;
-
Software licence agreements; and
-
Other obligations applicable to your use.
Rufino Group (Pty) Ltd does not authorise or encourage use of Work Horse to falsify records, impersonate another person, obtain unauthorised access, unlawfully circumvent security controls, or engage in conduct prohibited by applicable law or contractual obligations.
Work Horse does not determine whether a particular use is permitted by your employer, organisation, school, software provider, or another third party.
You are responsible for determining whether your intended use is permitted.
6. Activity and Presence Indicators
Some communication and productivity applications use computer activity, application activity, device state, idle time, network activity, calendar information, or other signals to determine whether a user appears online, active, idle, away, busy, or unavailable.
Work Horse may generate mouse or keyboard activity that affects how some third-party applications respond to device activity.
Work Horse does not control third-party presence systems.
We do not guarantee that Work Horse will:

Keep an account displayed as online;
-
Prevent an account from becoming idle or away;
-
Prevent a Mac from locking or sleeping under every configuration;
-
Affect a particular application's presence indicator;
-
Maintain any particular status for a specific period;
-
Override administrative or device-management settings; or
-
Continue working with a third-party application after that application's software, security system, or policies change.
A third-party application's presence indicator does not establish that a person is actively performing work.
Work Horse does not verify, certify, monitor, or make representations regarding a user's employment activity, productivity, attendance, working hours, availability, or physical presence.
7. Accessibility Permission
Certain Work Horse functionality may require macOS Accessibility permission.
Accessibility access enables Work Horse to perform system-level automation actions authorised by the user, including simulated mouse or keyboard input.
You are responsible for deciding whether to grant this permission.
You may revoke Accessibility permission through macOS system settings.
If you deny or revoke required permissions, certain Work Horse functionality may stop working or become unavailable.
You acknowledge that automation software may interact with whichever compatible application or input field is active at the time an automated action occurs.
You are responsible for ensuring the correct application, window, account, and input field are active before running an automation.
8. Automated Keyboard Input
Work Horse may automatically enter text, characters, commands, keyboard shortcuts, or other user-configured input.
You are solely responsible for the content and consequences of automated input configured by you.
You should not configure Work Horse to automatically enter sensitive information unless you understand and accept the associated risks.
Sensitive information may include passwords, authentication codes, recovery codes, financial information, confidential business information, personal information, or other restricted information.
Rufino Group (Pty) Ltd is not responsible for information being entered into an unintended application, chat, document, browser window, form, account, or other destination as a result of your configuration or use of Work Horse.
9. Advertising
9.1 In-App Advertising
Work Horse is supported by advertising.
The App uses Google AdMob to provide advertisements.
Depending on the App version, availability, and configuration, advertisements may include banner, interstitial, native, or other supported advertising formats.
By using Work Horse, you acknowledge that advertisements may be displayed during your use of the App.
9.2 Google AdMob
Google AdMob is an advertising service operated by Google LLC.
Google AdMob and associated advertising technology may collect or process certain technical, device, advertising, diagnostic, performance, and interaction information in connection with advertisement delivery.
Google's processing of this information is governed by Google's own terms, privacy policies, advertising policies, and applicable law.
Rufino Group (Pty) Ltd does not control all information independently processed by Google.

9.3 Personalised and Non-Personalised Advertisements
Advertisements displayed in Work Horse may be personalised or non-personalised depending on factors including:

Applicable law;
-
Geographic location;
-
User consent;
-
Privacy settings;
-
Advertising identifiers;
-
Device configuration; and
-
Google's advertising systems and policies.
Where required, users may be provided with privacy or consent choices relating to advertising.
Declining personalised advertising does not necessarily prevent advertisements from appearing in Work Horse.
9.4 Advertising Availability
We do not guarantee:
-
That advertisements will always be available;
-
That a particular advertisement will load;
-
That advertisements will be relevant to you;
-
That an advertising network will fill every advertising request;
-
That an advertisement will display correctly; or
-
That advertising services will operate without interruption.
Advertising availability may be affected by network conditions, location, user consent, third-party services, technical failures, advertising inventory, or other circumstances outside our control.
9.5 Third-Party Advertisements
We do not control the content, claims, products, services, websites, applications, or offers promoted by third-party advertisers.
Displaying an advertisement does not mean Rufino Group (Pty) Ltd endorses the advertiser, product, service, or offer.
If you interact with an advertisement or visit a third-party website or application, you do so at your own discretion.
Any transaction or relationship between you and an advertiser is solely between you and that advertiser unless expressly stated otherwise.
10. Third-Party Applications and Services
Work Horse may interact with third-party applications through mouse and keyboard input.
Unless expressly stated otherwise, Work Horse and Rufino Group (Pty) Ltd are not affiliated with, sponsored by, endorsed by, or partnered with the providers of those third-party applications.
All third-party names, trademarks, service marks, and logos remain the property of their respective owners.
Your use of third-party applications remains subject to the terms, policies, licences, and restrictions imposed by their providers.
You are responsible for complying with those requirements.
11. Third-Party Compatibility
We do not guarantee compatibility with any particular third-party application or service.
Third-party providers may modify their software, interfaces, security systems, policies, presence systems, automation detection, or technical behaviour at any time.
A feature that works with a particular application today may work differently or stop working in the future.
References to compatibility with a third-party service describe technical functionality only and do not represent endorsement, partnership, certification, or guarantee.
12. Privacy and Data
Our Privacy Policy forms part of these Terms and explains how information is handled when you use Work Horse.
Work Horse does not require a Rufino Group account to use its core automation functionality.
The App's automation settings and user-configured automation activity are processed locally on your Mac and are not transmitted to Rufino Group (Pty) Ltd servers.
However, Work Horse uses Google AdMob to provide advertising.
Google AdMob may independently collect or process certain device, advertising, performance, diagnostic, technical, and interaction information.
The use of Google AdMob therefore means that not all data processing associated with Work Horse occurs exclusively on your Mac.

13. Intellectual Property
Work Horse, including its software, source code, object code, interface, visual design, graphics, icons, branding, logos, names, documentation, text, features, and other original content, is owned by or licensed to Rufino Group (Pty) Ltd and protected by applicable intellectual-property laws.
Nothing in these Terms transfers ownership of Work Horse or associated intellectual property to you.
14. Updates and Changes to Work Horse
We may release updates, improvements, bug fixes, advertising changes, new functionality, or other modifications to Work Horse.
Changes may be required because of:

macOS updates;
-
Apple requirements;
-
Google AdMob changes;
-
Advertising requirements;
-
Security considerations;
-
Technical limitations;
-
Third-party application changes;
-
Legal requirements; or
-
Product-development decisions.
Certain features may stop functioning until an updated version of Work Horse is installed.
15. Disclaimer of Warranties
Work Horse is provided on an “as is” and “as available” basis.
To the fullest extent permitted by applicable law, Rufino Group (Pty) Ltd makes no warranties, express or implied, regarding merchantability, fitness for a particular purpose, compatibility, reliability, availability, security, or non-infringement.
We do not guarantee that:

Work Horse will operate without interruption;
-
Work Horse will be error-free;
-
Every automation will execute exactly as expected;
-
Mouse or keyboard activity will occur at an exact time;
-
Work Horse will remain compatible with every macOS version;
-
Work Horse will remain compatible with a particular third-party application;
-
Work Horse will maintain a particular activity or presence status;
-
Work Horse will prevent sleep, locking, inactivity, or idle status in every situation;
-
A third-party application will interpret Work Horse activity in a particular way;
-
Advertisements will always be available;
-
Advertisements will be accurate, appropriate, or relevant; or
-
Every defect or compatibility issue will be corrected.
16. Limitation of Liability
To the fullest extent permitted by applicable law, Rufino Group (Pty) Ltd, its directors, employees, contractors, agents, licensors, and service providers shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or connected with your use of, or inability to use, Work Horse.
This includes loss or damage arising from:

Incorrect automated keyboard input;

Incorrect mouse input;
-
Messages sent unintentionally;
-
Text entered into an unintended application;
-
Commands executed unintentionally;
-
Loss of data;
-
Loss of access to a third-party account;
-
Changes to a third-party application's status or presence indicator;
-
Workplace or organisational consequences;
-
Account restrictions;
-
Device-management restrictions;
-
Software incompatibility;
-
macOS updates;
-
Third-party application updates;
-
Advertising interruptions;
-
Advertisements or third-party advertiser content;
-
Third-party websites accessed through advertisements;
-
Downtime;
-
Lost profits;
-
Lost opportunities;
-
Business interruption; or
-
Loss of reputation.
Nothing in these Terms excludes liability that cannot lawfully be excluded or limited.
17. Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold harmless Rufino Group (Pty) Ltd and its directors, officers, employees, contractors, agents, and licensors from claims, liabilities, losses, damages, costs, and expenses arising from or relating to:

Your unlawful use of Work Horse;

Your violation of these Terms;
-
Your violation of applicable law;
-
Your violation of third-party rights;
-
Your violation of a workplace or organisational policy;
-
Automated content configured or submitted by you;
-
Your unauthorised use of another person's device or account; or
-
Your misuse of Work Horse.
18. Termination
You may stop using Work Horse at any time by closing or uninstalling the App.
We may suspend, restrict, or terminate your right to use Work Horse where reasonably necessary, including where we believe you have materially breached these Terms or are using the App unlawfully.
Upon termination, the licence granted under these Terms will cease.
19. Governing Law and Dispute Resolution
These Terms are governed by and interpreted in accordance with the laws of the Republic of South Africa.
Where a dispute arises relating to these Terms or Work Horse, the parties should first attempt to resolve the dispute through good-faith communication.
If the dispute cannot be resolved informally, it may be referred to the competent courts of the Republic of South Africa, subject to mandatory rights available under applicable consumer-protection law.
Nothing in these Terms is intended to limit rights that cannot lawfully be excluded under applicable South African consumer-protection legislation.
20. Mac App Store Terms
Where Work Horse is downloaded through Apple's Mac App Store, your use of Work Horse is also subject to applicable Apple terms and usage rules.
These Terms are between you and Rufino Group (Pty) Ltd and not between you and Apple.
Rufino Group (Pty) Ltd, and not Apple, is responsible for Work Horse and its content, subject to applicable Apple requirements.
Nothing in these Terms is intended to conflict with mandatory Apple App Store terms applicable to Work Horse.
21. Changes to These Terms
We may update these Terms to reflect changes to Work Horse, advertising functionality, Google AdMob, our business, applicable law, Apple requirements, security requirements, or technical functionality.
When material changes are made, the effective date will be updated.
If you do not agree with revised Terms, you should stop using and uninstall Work Horse.
22. Severability
If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision will be interpreted or modified to the minimum extent necessary to make it enforceable where legally possible.
If modification is not possible, the affected provision will be severed.
The remaining provisions will continue in full force and effect.
23. Entire Agreement
These Terms, together with the Work Horse Privacy Policy and any mandatory terms imposed by the platform through which Work Horse is distributed, constitute the agreement between you and Rufino Group (Pty) Ltd regarding your use of Work Horse.
