1. Acceptance of Terms

By downloading, installing, or using the GoScribble mobile application ("App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the App. These Terms constitute a legally binding agreement between you and Rufino Group (Pty) Ltd ("we", "us", or "our"), a company registered in the Republic of South Africa.

We reserve the right to update or modify these Terms at any time. Continued use of the App following any such changes constitutes your acceptance of the revised Terms. We will indicate the effective date of the most recent update at the top of this document.

2. About GoScribble

GoScribble is a free mobile score-keeping utility designed for use during in-person tabletop, card, and party games. The App tracks per-turn scores across multiple players, supports custom game names and player avatars, themed visual styling, optional hidden-score mode, sound effects, score history, podium-style results, and shareable result cards. GoScribble does not involve real-money gambling, wagering, or any form of financial transactions.

3. Eligibility

GoScribble is intended for general audiences and is suitable for all ages. By using the App, you represent that:

- You are at least 13 years of age, or that you have obtained consent from a parent or legal guardian if you are under 13;

- You have the legal capacity to enter into a binding agreement in your jurisdiction; and

- Your use of the App complies with all applicable laws and regulations.

- Parents and guardians are encouraged to supervise their children's use of the App. The App does not collect personal information from - children under 13 without verifiable parental consent.

4. Licence to Use

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to download and use GoScribble on a mobile device that you own or control, solely for your personal, non-commercial purposes.

You may not:

- Copy, modify, distribute, sell, or lease any part of the App;

- Reverse engineer, decompile, or attempt to extract the source code of the App;

- Use the App for any commercial purpose or in any way that is not expressly permitted by these Terms;

- Remove, alter, or obscure any proprietary notices, labels, or marks on the App; or

- Use the App in any manner that could damage, disable, overburden, or impair our servers or networks.

5. Intellectual Property

All content, design, graphics, code, sounds, animations, and other elements of GoScribble are the exclusive property of Rufino Group (Pty) Ltd or its licensors and are protected by applicable intellectual property laws, including the Copyright Act 98 of 1978 (South Africa) and international copyright treaties.

Nothing in these Terms transfers any intellectual property rights to you. Your use of the App does not grant you any right, title, or interest in or to the App or its content beyond the limited licence set out in Section 4.

6. Advertising and Third-Party Services

6.1 In-App Advertising

GoScribble is free to use and is supported by advertising. The App uses Google AdMob to display banner and interstitial advertisements. Ads may appear periodically during your use of the App. By using GoScribble, you acknowledge and agree to the display of such advertisements.

6.2 Google AdMob

GoScribble uses Google AdMob, a third-party advertising service operated by Google LLC. AdMob may collect and use certain data from your device, including device identifiers, in order to serve personalised or non-personalised advertisements. Google's data practices are governed by the Google Privacy Policy, available at https://policies.google.com/privacy.

We do not control the content of advertisements served by AdMob. We are not responsible for any third-party websites, products, or services that may be accessed through advertisements displayed in the App.

6.3 App Tracking Transparency (iOS)

On iOS devices, the App will request permission to track your activity across apps and websites owned by other companies using Apple's App Tracking Transparency (ATT) framework. You may choose to allow or decline tracking. If you decline, the App will continue to function normally; you may receive non-personalised advertisements instead.

6.4 No In-App Purchases

GoScribble does not offer, and does not currently plan to offer, any in-app purchases, subscriptions, or paid features. The App is entirely free to use.

7. Privacy and Data

Your privacy is important to us. Our Privacy Policy, which is incorporated into these Terms by reference, explains how we collect, use, and share information when you use GoScribble. By using the App, you agree to our Privacy Policy.

GoScribble does not require you to create an account. We do not collect your name, email address, or any personal identifying information directly through the App. Player names, avatars, scores, and game history that you enter are stored locally on your device. Data collected by third-party services such as Google AdMob is subject to their respective privacy policies.

8. Disclaimer of Warranties

GoScribble is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied. To the fullest extent permitted by applicable law, Rufino Group (Pty) Ltd disclaims all warranties, including but not limited to:

- Implied warranties of merchantability, fitness for a particular purpose, and non-infringement;

- That the App will be uninterrupted, error-free, or free of viruses or other harmful components;

- That the results obtained from use of the App will be accurate or reliable; and

- That any defects in the App will be corrected.

The score-tracking, totalling, and ranking functionality in GoScribble is designed to assist with casual gameplay. We make no representation that score calculations or results displayed by the App are guaranteed to be free of error or suitable for any purpose beyond informal personal use; you are responsible for verifying any score before relying on it for competitive or official purposes.

9. Limitation of Liability

To the fullest extent permitted by applicable law, Rufino Group (Pty) Ltd, its directors, employees, agents, licensors, and service providers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of, or inability to use, GoScribble.

In jurisdictions that do not allow the exclusion or limitation of certain damages, our liability shall be limited to the maximum extent permitted by law. In no event shall our total liability to you exceed the amount you paid to use the App in the twelve months preceding the claim, which in the case of a free app is zero.

This limitation of liability does not affect any liability that cannot be excluded or limited under the Consumer Protection Act 68 of 2008 (South Africa) or any other applicable mandatory consumer protection legislation.

10. Indemnification

You agree to indemnify, defend, and hold harmless Rufino Group (Pty) Ltd and its officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with:

- Your use of the App in violation of these Terms;

- Your violation of any applicable law or regulation; or

- Your infringement of any third-party rights.

11. Termination

We reserve the right to suspend or terminate your access to GoScribble at any time, without notice, for any reason, including if we reasonably believe you have violated these Terms.

You may stop using the App at any time by uninstalling it from your device.

Upon termination, the licence granted to you under Section 4 will immediately cease. Sections 5, 8, 9, 10, 12, and 13 shall survive any termination of these Terms.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa, without regard to its conflict of law provisions.

Any dispute, controversy, or claim arising out of or in connection with these Terms, or the breach, termination, or invalidity thereof, shall first be submitted to good-faith negotiation between the parties. If the dispute is not resolved within 30 days, it shall be referred to and finally resolved by the competent courts of South Africa, to whose jurisdiction you irrevocably submit.

If you are a consumer resident in South Africa, nothing in these Terms limits your rights under the Consumer Protection Act 68 of 2008, the Electronic Communications and Transactions Act 25 of 2002, or any other applicable consumer protection legislation.

13. App Store Terms

GoScribble is distributed through the Apple App Store and Google Play Store. Your use of the App is also subject to the terms and conditions of the relevant app store from which you downloaded it. In the event of any conflict between these Terms and the applicable app store terms, the app store terms shall prevail to the extent of the conflict.

Apple Inc. and Google LLC are not parties to these Terms and bear no responsibility for the App or its content. Any claims relating to the App must be directed to Rufino Group (Pty) Ltd, not to Apple or Google.

14. Changes to the App

We reserve the right to modify, update, suspend, or discontinue GoScribble (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the App.

We may release updates to the App from time to time. Depending on the update, you may not be able to use the App until you have downloaded and installed the latest version.

15. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, it shall be severed from these Terms. The remaining provisions shall continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Rufino Group (Pty) Ltd with respect to GoScribble and supersede all prior or contemporaneous agreements, representations, warranties, and understandings between you and us relating to the subject matter hereof.
